Cancellation of subclass 457 (temporary long stay employment visas) is on the rise. Where a visa holder has ceased employment with their nominated employer but have both lodged a new nomination application with 90 days, cancellation for not complying with condition 8107.

However where the 457 visa holder has ceased employment with the nominator (ie breach of 8107) and a new nomination has not been lodged within 90 days cancellation will proceed and a Notice of Intention to Consider Cancellation (NOICC) will be issued.

Relevant factors and reasons may be considered  before cancellation. Changes to 8107 from 19th November 2016 after this date.

The period during which the visa holder may remain in Australia is slashed from 90 to 60 days. This only applies to visas granted on or after 29 November 2016.
